Official Rules

NO PURCHASE NECESSARY. MANY WILL ENTER, FEW WILL WIN.

The “Old El Paso” Sweepstakes (the “Sweepstakes”) commences May 6th at 11:59 A.M. Central Standard Time (“CST”) and concludes May 19th at 11:59 A.M. CST (the “Sweepstakes Period”). The Sweepstakes is sponsored by General Mills Marketing, Inc. (“Sponsor”).

1. ELIGIBILITY

The Sweepstakes is open to all who have entered and reached the age of 18 on or before May 6 , 2023. The Sweepstakes is only open to legal residents of the United States of America and the District of Columbia and is void where prohibited by law.

Notwithstanding the above, the Sweepstakes is not open to individuals associated with the Sweepstakes, including the employees, agents or representatives of the Sponsor (including their respective divisions, subsidiaries, affiliates and advertising or promotional agencies) or others providing prizes or other materials or services in connection with this Sweepstakes (collectively, the “Excluded Individuals”). This Sweepstakes is also not open to the immediate family members of the Excluded Individuals, and all other persons with whom the Excluded Individuals reside. The Sweepstakes is subject to all applicable federal, province and local laws and regulations. Void where prohibited.

2. HOW TO ENTER

Entries must be submitted during the Sweepstakes period, which begins on May 6, 2023, at 11:59 A.M. CST and ends 11:59pm May 19, 2023. Only complete entries will be eligible. Sweepstakes entry limited to one entry per person/household. Sponsor will not verify receipt of entries. Automated entries are prohibited, and any use of such automated devices or programs will cause disqualification. Sponsor and its advertising and promotion agencies are not responsible for lost, late, illegible, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic. Sweepstakes entries are the property of Sponsor and will not be returned.

Also, please make sure you understand and agree that we (Sponsor and its affiliates):

o Reserve the right to change any of these rules or the site at any time. All changes will be effective upon posting to the site. Your continued use of the site following the posting of changes to these rules or the website, including the Privacy Policy, will mean you accept those changes.

SPONSOR AND ALL AFFILIATES THEREOF WILL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR USE OF THE WEBSITE, WHETHER IN CONTRACT OR IN TORT, EVEN IF WE HAVE BEEN ADVISED OF (OR KNEW OR SHOULD HAVE KNOWN OF) THE POSSIBILITY OF SUCH DAMAGES. IF ANY PORTION OF THESE LIMITATIONS ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF SPONSOR AND ALL AFFILIATES THEREOF SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

3. SOCIAL MEDIA DISCLAIMERS AND POLICIES

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook. Sponsor and all Sweepstakes entrants fully release Instagram and Facebook from any claims or issue arising from this Sweepstakes.

4. SWEEPSTAKES

There are 10 Old El Paso prize package containing 1 Old El Paso Cookbook, “20-Minute Mexican-Style Meals” as well as Old El Paso products. One per entrant/household. Approximate retail value of each Prize is $150.00 USD. Total retail value of all prize packages is $1,500USD. Prizes will be fulfilled within 4 weeks of the end of Sweepstakes.

Odds of winning depend on number of eligible entries received throughout the Sweepstakes Period. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prizes cannot be transferred, assigned, substituted, or redeemed for cash, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute prize (or portion thereof) for one of comparable or greater value. All applicable federal, state or local taxes, as well as any other costs and expenses associated with prize acceptance not specified herein as being provided are the responsibility of the winner. All prize details are at the sole discretion of the Sponsor Limit one (1) prize per person. No more than the stated number of prizes will be awarded.

5. SELECTION OF WINNERS AND PRIZE CLAIMS

Potential Winners Selection. Administrator will select one potential prize winner (each a “Potential Winner”) at random on or about May 28, 2023 from all eligible entries. Winners will be notified via email upon completion of the online request form. Sponsor shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk email or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent the prize may be forfeited, and an alternate winner selected.

The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and province laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

6. GENERAL

In addition to the foregoing, in order to be declared a winner by the Sweepstakes judges, a potential winner must be in compliance with these Official Rules and, in particular, the following: If a potential or declared winner is not in compliance with these Official Rules, the Sponsor reserves the right to disqualify such entrant from the Sweepstakes and select further entrants from the remaining eligible entries until a substitute winner is finally declared. Each declared winner consents to the Sponsor’s use of his/her name, city of residence, entry photograph, voice, and image for any publicity or programming purposes, in all media, without remuneration, throughout the world in perpetuity.

All entries become the sole property of, and are subject to verification by, the Sponsor. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. Any attempt to tamper with the entry process, interfere with these Official Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Sweepstakes, (collectively referred to as “Prohibited Acts”), is a violation of criminal and civil laws, and the Sponsor reserves the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future Sponsor’s Sweepstakes. For further clarity, Prohibited Acts include, without limitation, the use of any automated equipment to participate in this Sweepstakes. The Sponsor assumes no responsibility for: entries lost, stolen, delayed, damaged or misdirected, or for the failure, interruption, or delay of any email or other communication to be received, for any reason; problems with the function of any website or website feature howsoever caused; the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; any functionality lost due to not having cookies enabled; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”. The Sponsor and Sweepstakes Delegate shall not be held responsible for any accident, negligence, printing, administrative, or other errors that may arise or occur in connected with the Sweepstakes. In the event of a dispute regarding submission of an on-line entry, the entry will be deemed to be submitted by the authorized holder of the e-mail account. In the event of a dispute as to any entrant’s submission, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. Proof of sending will not be deemed to be proof of receipt.

Sponsor also reserves the right at its sole discretion to disqualify from this Sweepstakes and any future Sweepstakes or other promotion Sponsor conducts, any individual that it finds or believes to be tampering with the entry process or the operation of the Sweepstakes or Sweepstakes Website, to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and the decisions of the Sponsor and the Sweepstakes Delegate, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

The Sponsor reserves the right, in their sole discretion, to substitute any component of a prize for its cash value or a prize of approximately the same retail value. Prizes are non-transferable, must be accepted as awarded by the Sponsor and cannot be exchanged by a declared winner for cash or other substitutes. The refusal by an entrant to accept any prize releases and forever discharges Sponsor and Sweepstakes Delegate of all obligations related to the Sweepstakes or prizes including delivery. The Sponsor reserves the right, at their sole discretion and without prior notice, to amend, cancel, close, or suspend this Sweepstakes at any time and for any reason whatsoever. By entering the Sweepstakes, each entrant agrees to abide by these Official Rules, which shall be final and legally binding in all matters relating to this Sweepstakes, and which are subject to change without notice to Sweepstakes entrants individually, and each entrant releases the Sponsor, their respective parents, affiliates, subsidiaries, directors, officers, employees, representatives, agents and advertising and promotional agencies, from all claims or damages, loss or liability suffered as a result of or arising from the entrant’s participation in the Sweepstakes or the use of any prize. By accepting a prize, each winner agrees to the use of his/her name, city of residence, photograph and/or other likeness in any related publicity for the Sponsor, in any medium, including presence on the Sponsor’s website, without further compensation or permission, worldwide and in perpetuity. Sponsor makes no representation or warranty that any identification, videotape, photograph and/or likeness of any of the winner will be broadcast or used otherwise in any manner. The Sweepstakes is void where prohibited by law and in Rhode Island and is subject to all applicable federal, province and municipal laws and regulations. All decisions of the Sponsor and Sweepstakes Delegate are final and binding on all matters relating to the Sweepstakes. The Sweepstakes and these Official Rules shall be exclusively governed by and construed in accordance with the laws of the United Provinces.

By entering the Sweepstakes, entrants agree that the Sponsor shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Sweepstakes or acceptance, possession and/or use or misuse of the prize, and agree to release, discharge and hold harmless the Sponsor, the Sweepstakes Delegate and their respective officers, directors, parent companies, subsidiaries, affiliates, related companies, advertising and promotional agencies, third party services’ providers and prize suppliers from all claims or damages arising out of entrant’s participation in the Sweepstakes and/or acceptance, use or misuse of any prize. By entering the Sweepstakes and voluntarily providing his/her personal information, each entrant consents and agrees to the collection, use, and disclosure of the entrant’s personal information by Sponsor and its authorized agents for the purpose of administering the Sweepstakes and fulfilling the prize. The Sponsor will not use an entrant’s personal information for any other reason nor will the Sponsor otherwise disclose it to any third party without consent of entrant.
